Judgment
Virendra Saran, J.—Heard learned counsel for the applicant, learned State counsel and perused the order dated 219 93, passed by Special Judge, (E. C. Act) Basti
2 Admittedly 809 bags of fertiliser were recovered from the applicant. The order of the special Judge shows that for the last mote than one year there has been no progress in the case. The fertilizer has recovered in a case under Section 3/7 E. C. Act read with Sections 353, 504, 506, IPC. CrimeNo, 193 of 92, P. S. Mabuli district BastiStare v. Chhidilal.
In case fertiliser is not been utilised within reasonable time it will become useless.
4 Considering entire circumstances of the case, it is expedient in the interest of justice that the fertiliser may be released in favour of the applicant.
5 in the result, this revision is allowed. The 809 fertiliser bags seized in connection with the above mentioned crime shall be released m favour of the applicant on his furnishing security other than cash or bank guarantee.
6 With the above observations/directions this revision is finally disposed of.
7 A certified copy of the order shall be issued to the learned counsel for the applicant on payment of usual charges within three days.
