It has been reported by the Sub Inspector of Police Vengara Police Station that the investigation of the case has been presently stopped

temporarily on account of the nonavailability of the records from the Sub Regional Transport Office, Tirur. This is a case wherein it is alleged that

by forging the records, the son got transferred the vehicle belongs to his father to his name, that too with the connivance and assistance of the

employees of the RTO Office concerned.

The learned Public Prosecutor has produced the letter from the Joint Regional Transport Officer, Tirur addressed to the Sub Inspector of

Police, Vengara wherein it has been stated that the entries in the computer relating to the transaction were made at the instance of one Sreelatha,

who has been presently transferred to the Sub Regional Transport Office, Tirurangadi, the then Junior Superintendent namely Suffurulla, who is

presently promoted and transferred to as the Senior Superintendent, RTO Office, Kozhikode and also the then joint RTO namely M.P. Subash

Babu, who is presently working as Joint RTO at the Sub RTO Office, Sultan Bathery. The investigating officer ought to have proceeded against

the said persons also who were part and parcel of the illegal transaction, instead of stopping the investigation temporarily and waiting for the

records. No such records will be available. It is devoid of commonsense to say that he is waiting for the records.

The Crime Branch shall immediately take up the investigation and continue with the investigation by arraigning the aforesaid officers of the RTO

office also as accused in the case. The investigation shall be conducted by an officer not below the rank of Deputy Superintendent of Police

attached to the Crime Branch.

In the result, this Writ Petition is disposed of with the above said directions and with liberty to the petitioner to approach this Court again, in case

of further latches from the part of the investigating officer.
