Judgment
Raj Mohan Singh, J
The case has been taken up for hearing through video-conferencing.
Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.0254 dated 01.10.2020 registered under Sections 306 and
34 IPC at Police Station Lehra, District Sangrur.
On 12.11.2020, following order was passed by this Court:-
“The case has been taken up for hearing through video-conferencing.
Learned counsel for the petitioner relies upon pendency of CRM-M No.35125 of 2020. Petitioner is wife of Satpal Singh, in whose case notice of
motion has been issued for 6.1.2021 along with interim directions.
Notice of motion for 6.1.2021.
In the meanwhile, petitioner is directed to appear before the SHO/Investigating Officer to join investigation on 19.11.2020 at 11.00 a.m. and in the
event of her arrest, she shall be enlarged on ad interim bail, subject to her furnishing requisite bail bonds/surety bonds to the satisfaction of Arresting
Officer. However, petitioner shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.
To be heard along with CRM-M No.35125 of 2020.â€
Learned counsel for the complainant opposed the bail on the ground that the private expert at the instance of the complainant has given a report of
comparison of Handwriting and found the same to be of Mandeep Kaur.
On a pointed query, learned State counsel on instructions from SI Bikramjit Singh submits that the police has not sent any Handwriting of Mandeep
Kaur to any Government Expert for want of alternative Handwriting of the deceased on any document.
Learned State counsel further submits that in compliance of order dated 12.11.2020, the petitioner has joined the investigation and she is no more
required in further investigation of the case.
In view of above, order dated 12.11.2020 is hereby made absolute.
However, the petitioner shall keep on joining the investigation as and when required to do so by the Investigating Officer.
