Petitioner has sought transfer of the respondent no.3 from the post of Tehsildar, Haridwar. According to the petitioner, he is a practicing Advocate
in Tehsil, Haridwar, where the respondent no.3 is Tehsildar. The petitioner had, in the past, gave various complaints against working of the respondent
no.3. Now, the petitioner is contesting Assembly Election, 2022, he apprehends that the respondent no.3, who is Assistant Returning Officer may
cause damage to him.
Heard learned counsel for the parties through video conferencing and perused the record.
Instant petition has no basis at all. It does not require any deliberation. If a person has lodged any complaint against the public servant, how could
somebody presume that the public servant has become inimical to such person. Particularly, in the instant case, the apprehension of the petitioner that
the respondent no.3 may cause damage to the petitioner in this election is really without any basis. Therefore, this Court of the view that there is no
merit in the writ petition and deserves to be dismissed at the stage of admission itself.
The writ petition is dismissed in limine.
