Heard Mr. P.R.Singh, learned counsel for the petitioner and Mr. R.P.Mohapatra, learned Additional Government Advocate through video conferencing mode.
According to Mr. Singh, the grievance of the petitioner in this case pertains to non-registration of his F.I.R. i.e. Patkura P.S. Case No. 417 dated 27.8.2021 under the appropriate provisions of law. He further submits that the F.I.R. should also have been registered for commission of offences under Sections 366, 366-A and 376 of I.P.C. in the facts and circumstances of the case.
During course of hearing, Mr. Singh submits that liberty may be granted to the petitioner to move the Superintendent of Police, Kendrapara (opposite party No.2) in the matter by filing a grievance petition and the said opposite party be directed to take a decision on such motion at an early date.
Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a grievance petition before opposite party No.2 through registered post within a period of two weeks from today. In the event, such a petition is filed along with a copy of this order, the opposite party No.2 would do well to take a decision on the same in accordance with law within a period of six weeks from the date of receipt of such grievance petition and communicate the result of such exercise to the petitioner.
Accordingly, this CRLMP is disposed of.
Urgent certified copy of the order be granted on proper application.
