Judgment
K.Babu, J
This Crl.M.C is filed seeking the following relief:-
“.....to direct the Judicial First Class Magistrate-II, Nedumangad to release the petitioner on bail by considering his bail application on the same day on the event of his surrender in L.P.No.62/2007 in the interes of justice.”
The petitioner is the sole accused in L.P.No.62/2007.
The offence alleged against the petitioner is punishable under Section 436 of the Indian Penal Code.
Heard both sides.
The learned counsel for the petitioner submits that the petitioner is prepared to surrender before the Court below and co-operate with the trial. It is submitted that as the petitioner was employed in Tamil Nadu, he failed to get information regarding the proceedings in the Court below. If the petitioner appears before the Court below and files an application seeking regular bail, the same shall be considered and decided positively on the date of filing itself, in the light of the principles declared by the Apex Court in Satender Kumar Antil v CBI [(2022) 10 SCC 51].
The Crl.M.C is disposed of as above.
