Chandramouli, P.V. Vasudevan Namboodiri, T.P.Bhaskaran and M.K. Kanarakkutty vs Appellate Authority Under The Payment, Conrolling Authority Under The Payment and Kerala State Electricity Board

P.N. Ravindran, J.—The Petitioners, who are former employees of the Kerala State Electricity Board, hereinafter referred to as the Board for short, have filed this writ petition seeking expeditious payment of the amount of gratuity determined by the Controlling Authority in Ext.P1 series of orders, which have become final following the dismissal of the appeals filed by the Board before the appellate authority constituted under the Payment of Gratuity Act, 1972.

When the writ petition came up for hearing today the learned standing counsel appearing for the Board submitted that the entire amount of gratuity has been deposited with the first Respondent and that the money has been transferred to the second Respondent. The learned standing counsel also submitted that the Board has no objection in the Petitioners receiving payment of the gratuity from the second Respondent.

In the light of the said submission I dispose of this writ petition with a direction to the second Respondent to pay over the amount of gratuity mentioned in Ext.P1 series of orders to the Petitioners within one week from the date on which the Petitioners produce a certified copy of this judgment before the second Respondent.
