Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent.

The respondent-Police registered a case against the petitioner and others in Crime No.109/2017 in respect of offences punishable under Sections 420 of IPC.

The substance of the case is that the petitioner is the owner of the lorry bearing Regn.No.AP- 26-TA-3578. The petitioner along with others were transporting silica sand in the said lorry illegally on NH- 75 road on Gowtham Colony, Hosakote.

The learned counsel for the petitioner submits that similarly placed accused persons have already been granted bail by this court. Hence, he requests the court to grant bail to the petitioner also.

Having regard to the nature of the offence, the petitioner is entitled to be released on bail. Accordingly, petition is allowed and petitioner is granted anticipatory bail subject to following conditions:

i) The petitioner in the event of his arrest in Cr.No.109/2017 of Hosakote Police Station shall be released on bail, subject to the petitioner executing a personal bond for a sum of Rs.25,000/- with one solvent surety for the likesum.

ii) The petitioner shall not terrorize the witnesses or tamper with the prosecution evidence.
