Judgment
The instant petition has been filed by a practicing lawyer praying for the following reliefs:
"(i) Issue a writ of mandamus, directing and commanding the respondents to expedite the work on the bill, and execute and enforce the promise/declaration made by the Chief Minister with regard to implementation of Advocates Protection Act.
(ii) Any other order/orders, direction/directions may also be passed.
(iii) Cost of the petition may also kindly be awarded."
The contention of learned counsel for the petitioner is that a Bill by name of "Advocate's Protection Bill'2021" was drafted by the Bar Council of India vide Annexure P/7 and was circulated by the State Bar Council, High Court Bar Association and Supreme Court Bar Association and also other Bar associations of the country to invite objections. However, his grievance is that no further steps have been taken to present the bill in the parliament and to formulate a law to govern the field in question.
This court has its own limitations. Since no mandamus can be issued for promulgating a particular law by legislature, however, the State counsel is directed to seek instructions and apprise this Court about the present situation and the intention of the State with regard to promulgating law.
