BLAPL Nos.305 & 527 of 2024
Heard learned counsel for the Petitioners and learned counsel for the State.
The Petitioners are accused in connection with Special G.R. Case No.79 of 2022, pending in the Court of learned Sessions Judge-cum-Special Judge, Malkangiri arising out of Chitrakonda P.S. Case No.59 of 2022 for alleged commission of offences under Section 20(b)(ii)(C) of NDPS Act.
Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Special Judge, Malkangiri, by order dated 23.11.2023 in the aforementioned case, the present BLAPL has been filed.
Registry is requested to call for a report from the learned Court in seisin regarding the stage of trial and as to why in spite of the earlier direction trial could not be concluded within the time stipulated.
List this matter on 04.04.2024 along with such report.
Copies of the depositions of witnesses P.W.s.1 to 9 have been served on the learned counsel for the State.
Learned counsel for the Petitioners are requested to file the same in the Registry.
