Judgment
Heard Mr. D. Choudhury, learned Advocate for the petitioner and Mr. B. Choudhury, Advocate for the respondents.
This writ application has been filed for issue of a Mandamus to pay an amount of Rs. 9,12,546 (Rupees nine lacs twelve thousand five hundred forty six) only.
In this case Notice of Motion was issued on 31.3.2000 and the notice was made returnable within two months. No affidavit has been filed, no record has been produced by the respondents till today. The liability statement has been given by the Executive Engineer, PWD Rangia NH Division, Rangia.
It is submitted by Mr. Choudhury, learned Advocate for the petitioner that after this statement was given, some amount was given and hence the claim is made for the present amount.
Accordingly, I dispose of this writ application with a direction that the outstanding amount as on today after verification shall be paid to the petitioner within a period of six months. If the amount is not paid within this period, the amount shall carry interest @ 12 % from the date when it became due.
