Judgment
[1] Heard Mr. P. Maishan, learned counsel appearing for the petitioner as well as Ms. A. S. Lodh, learned Addl. G.A. appearing for the respondents.
[2] By means of this writ petition, the petitioner has urged this Court to direct the respondents to pay the medical reimbursement bill amounting to Rs. 2,96,653/- (Rupees two lakhs ninety six thousand six hundred fifty three) and to interfere with the letter dated 21.08.2014.
[3] This Court had requested Ms. A. S. Lodh, learned Addl. G.A. either to take instructions or to file a short affidavit why the respondents have not paid the full medical reimbursement bill.
[4] Today, Ms. Lodh, learned Addl. G.A. has furnished a copy of the communication made by the Director of Agriculture, Government of Tripura to the Deputy Director of Agriculture, Gomati, Udaipur, Gomati District communicating that the amount of Rs. 2,96,653/- is admissible as the medical reimbursement to the petitioner.
[5] The said medical reimbursement bill was for treatment of the wife of the petitioner. At the relevant time, the petitioner was the retired Head Clerk in the Department of Agriculture. However in the communication, the Director of Agriculture, Government of Tripura has mentioned that as a special case, the said sanction for the medical reimbursement has been granted by the Finance Department.
[6] Be that as it may, according to this Court, for the said decision taken by the Director of Agriculture with approval from the Finance Department this writ petition has become infructuous. Accordingly, the same is dismissed as infructuous.
[7] The respondents are directed to disburse the said amount within a month from the date when the petitioner shall submit a copy of this order to the Deputy Director, Agriculture, Gomati, Udaipur, Gomati District.
[8] The copy of the said communication dated 13.06.2017 shall be made part of the records for future reference. Copy of this order be furnished to the learned counsel appearing for the parties.
There shall be no order as to costs.
