Judgment
Surya Kant, J.—The Petitioner is seeking bail in case, FIR No. 791 dated 7.10.2003 under Sections 363/366/368, IPC, Police Station Old Faridabad.
It is not disputed that in the FIR, the name of the Petitioner does not figure and as per the contents thereof, it is Vijay Singh who is the real culprit who is alleged to have kidnapped the minor girl-Jyoti. The Petitioner is the uncle of Vijay Singh-main accused, who is in custody since 26.12.2003. Vijay Singh has also been arrested.
It is also not in dispute that the investigation is complete, charge-sheet was filed and thereafter the charges were also framed. Not only this, some prosecution witnesses including the complainant also been examined. Since the conclusion of the trial is likely to take some more time and the case of the Petitioner is totally distinguishable from the main accused-Vijay Singh, he is directed to be released on bail to the satisfaction of the Chief Judicial Magistrate, Faridabad.
Petition allowed.
