Heard learned counsel for the petitioner on the question of admission. Learned AGP appearing for respondent nos. 1 and 2 seeks time to take instruction and to file reply.
Learned counsel for the petitioner submits that the filling of the preference form for the admission in question has already started and in case the interim relief is not granted to the petitioner, the petitioner may suffer irreparable injury.
Having considered the submission made by the learned counsel for the petitioner, we are of the view that prima facie the petitioner who is seeking admission in Postgraduate medical course under the physical handicap category, deserves to be granted interim relief keeping in view the fact that the petitioner was allowed to appear in the MBBS course, which the petitioner has successfully cleared, inspite of the same disability. Accordingly, we grant interim relief in terms of prayer clause (e). However, the grant of interim relief will be subject to further order to this Court and the petitioner shall not be entitled to claim any equity on the basis of this order.
List the matter after two weeks. Respondents to file reply within two weeks.
