Heard Mr. A.S. Paul, learned counsel for the Petitioner and Ms. S. Mishra, learned Additional Standing Counsel.
This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Chandan Kumar Behera in connection with P.R. No.191 of 2017-18 of Excise E.B. Unit-II, Cuttack corresponding to 2(a)CC Case No.10 of 2018 pending in the court of learned 2nd
Additional Sessions Judge, Cuttack for alleged commission of offence under Section 21(c) of the NDPS Act.
Considering the quantity of contraband, i.e. 'Heroin' weighing 450 grams, I am not inclined to release the Petitioner on bail keeping in view the embargo contained in Section 37(1)(b) of the NDPS Act. Accordingly, the prayer for bail is rejected.
Perused the report of learned 2nd Additional Sessions Judge, Cuttack dated 10th November, 2021 as placed on record. The learned trial court is directed to conclude the trial by end of March, 2022 by taking all steps to procure the attendance of the I.O. and report compliance to this Court.
The BLAPL is accordingly disposed of.
An urgent certified copy of this order be issued as per rules.
