Judgment

Heard on I.A. No.408/2026, an application under Section 5 of the Limitation Act.
For the reasons mentioned in the application, same is allowed and the delay of 03 days in filing this MCC is hereby condoned.
This application has been filed for extension of time to deposit the cost of Rs.20,000/-, as imposed by this Court by order dated 12.08.2025, passed in S.A. No. 300/2011.
It is submitted by counsel for applicant that by aforesaid order, the cost was directed to be deposited within a period of one week from 12.08.2025. Although the cost should have been deposited by 20.08.2025, but as there was some delay in depositing the cost, therefore, the Office has not accepted the cost which was sought to be deposited by the applicant, accordingly, it is submitted that he is ready to deposit the cost even during the course of the day.
In view of submissions made by counsel for the applicant, this MCC is allowed, and it is directed that in case if the cost is deposited during the course of the day, then it shall be accepted, and time to deposit the cost shall stand extended upto 20.01.2026.
It is made clear that in case if the cost is not deposited, then no further opportunity shall be granted, and the consequences of non-deposit of cost shall be considered while considering S.A. No. 300/2011.
With aforesaid observation, this MCC is finally disposed of.
