The instant criminal miscellaneous application has been preferred seeking correction in the order dated 25.08.2023 passed by this court in S.B. Criminal Misc. Suspension of Sentence (Appeal) Application No.680/2023, whereby the sentences awarded to the appellant-applicant by the learned Special Judge, Prevention of Corruption Act Cases, Bhilwara vide judgment dated 12.06.2023 passed in Sessions Case No.69/2015 for the offences under Sections 7 and 13(1)(D) read with Section 13(2) of the Prevention of Corruption Act were suspended.
It is averred in the application that due to inadvertent error, in the aforesaid order, the date of the impugned judgment has been mentioned as '11.08.2023' instead of '12.06.2023'. Hence, it is prayed that necessary correction may be made in the order.
Having gone through the impugned judgment as well as the documents placed on record with the file, this court is of the opinion that apparently an inadvertent typographical error has crept in the order allowing the application seeking suspension of sentence and it is essential to rectify the same.
Accordingly, it is ordered that the date of the impugned judgment, wherever appearing wrong in the order dated 25.08.2023 passed by this court in S.B. Criminal Misc. Suspension of Sentence (Appeal) Application No.680/2023 shall be read as '12.06.2023' instead of '11.08.2023'. The application is allowed in these terms.
This order shall be treated as part and parcel of the order dated 25.08.2023.
