Judgment
The petitioner a proprietorship concern, is an importer engaged in the import and trading of Old and Used Digital Multifunctional devises (for short "MUD's"). His grievance is that one of the consignment of import such goods from Singapore manufactured prior to 2012 have been detained and seized on the ground that the said MUD's are covered under the definition of "prohibited goods" being noncompliant of BIS standards in view of CRO-2012 issued by the Ministry of Electronics, Information & Technology, Government of India, whereas the stand of the petitioner is that such MUD's are at best restrictive goods and thus, liable to be released upon payment of fine and penalty. Prayer, thus, is for provisional release under Section 18 read with Section 110-A of the Customs Act, 1962.
Upon notice, reply stands filed.
At the time of hearing, learned counsel for the petitioner prays for permission to withdraw the writ petition in view of the fact that his client has filed a separate writ petition bearing CWP-36829-2019 challenging the vires of CRO-2012 order as also the subsequent show cause notice dated 23.09.2019, while seeking similar relief of provisional release.
Learned counsel for the respondents possibly can have no objection.
Dismissed as withdrawn with the aforesaid liberty.
