Judgment
This is a matter of some concern that has been brought to the notice of this Court by way of the present public interest litigation. According to the petitioner, documents may have been manufactured, inter alia, by the State, for transportation of coal allegedly brought from Assam and originally meant for export to Bangladesh.
The respondent Nos. 1, 2 and 5 to 12 are represented. The respondent No. 13 is also represented. The other respondents, particularly the private respondent No. 14, should be served. A copy of this petition should also be forwarded to the State of Assam. The matter will appear ten days hence for a preliminary report to be filed by the State, indicating how the coal that was said to be dumped at Gasuapara in the South Garo Hills came into the State, with proof of the entry of the material into the State and the origin of the coal.
Since there are two respondents mistakenly marked as No. 3, the second of such respondents should be marked as respondent No. 3A. The Department will carry out the necessary correction on the basis of this order.
