The present interlocutory application has been filed by the applicants, namely, Ajay Kumar Keshri, Manohar Keshri, Ashok Kumar Keshri, Jwala

Prasad Keshri and Manoj Kumar Keshri seeking intervention in the present writ petition.

Mr. Jay Prakash Jha, learned senior counsel for the applicants/ interveners, while referring to different paragraphs of the present interlocutory

application, submits that the petitioner has suppressed the material facts before this Court with mala fide intention to cause wrongful loss to the

applicants/interveners. Plot nos.23, 24 and 25 under Jamabandi no.33(Ka) of Mouja Janakpur, Thana no.278, measuring an area of 4.48 acres has also

been made subject matter of the present writ petition filed by the petitioner, claiming her title and possession over the same, which, in fact, belongs to

the applicants and their family members, as the said land was settled by Ghatwali Estate as far back as in the year 1935 with Harkhu Sah and

Chintamani Sah, both sons of Tula Sah. Thereafter, rent was also fixed by Ghatwali Estate and on payment of the same, rent receipts were also

issued. Subsequently, on vesting of the said estate, the land appertaining to plot nos.23, 24 and 25 under Jamabandi no.33(Ka) of Mouja Janakpur,

Thana no.278, measuring an area of 4.48 acres was mutated in the names of Harkhu Sah and Chintamani Sah, rent of which is being presently paid by

the applicants, being their legal heirs.

Having heard learned counsel for the parties and on consideration of the present interlocutory application, the applicants are allowed to intervene in the

present writ petition. Accordingly, the petitioner is directed to implead the applicants named above as respondent nos.5 to 9.

Learned counsel for the petitioner is directed to make necessary insertion in the cause title of the writ petition within a period of one week.

I.A. No.6543 of 2020 stands disposed of.

W.P.C. No.2581 of 2020:

Mr. Ashish Shekhar, learned A.C. to S.C. (L&C)-II, submits that a counter affidavit on behalf of the State respondents has already been filed.

Mr. Jay Prakash Jha, learned senior counsel for the respondent nos.5 to 9 prays for and is allowed six weeks’ time to seek instructions and file

counter affidavit.
