Chaman Lal Sharma vs H.P. State Co-Operative Bank Ltd. And Another

By way of this petition, the petitioner has prayed for the following relief:-

"It is therefore respectfully prayed that in view of the facts stated above the petition may kindly be allowed and:

(a) The time for complying with the order dated 29.-08-2019 and subsequent orders passed by the Ld. Additional Sessions Judge-I, Sundernagar, Distt. Mandi, H.P. in CRMA No. 811/19 titled as Chaman Lal Sharma Versus HP State Co-operative Bank Ltd. And others may kindly be extended.

(b) The non-bailable warrants issued by the Ld. JMIC, Court No. 2, Sundernagar, Distt. Mandi, H.P. against the petitioner for 07.04.2020 may kindly be quashed.

(c) Any other appropriate orders or directions which this Hon'ble Court may deem appropriate in the facts and circumstances of the case be passed in the interest of justice."

In my considered view, this petition is completely mis-conceived as the best course available for the petitioner is to approach the learned Appellate Court below for the grant of appropriate relief(s), as the petitioner admittedly has not complied with the conditions imposed by the learned Appellate Court below, which were imposed while suspending the sentence. The petition is accordingly dismissed being mis-conceived. Pending miscellaneous application(s), if any, stand closed.
