Judgment
Ravindra Maithani, J
By means of the instant writ petition, petitioner seeks the following reliefs:
"(i) Issue a writ, order or direction in the nature of mandamus directing the respondents to release the total dues of the Petitioner after re-calculating the total dues of the Petitioner alongwith other retiral dues and benefits of the Petitioner alongwith interest upto the date of actual release of entire funds,
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents to release the papers of the flat of the Petitioner situated at Mumbai for which the Petitioner took housing loan bearing no.03750600600011, against which the Bank has issued NOC dated 26.05.2020 (Annexure No.10).
(iii) Issue any other or further writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case.
(iv) To award the cost of the petition in favour of the petitioner. "
It is the case of the petitioner that having worked with the respondents Bank for about 40 years, he retired on 31.07.2021. But, he has not been paid all of his retiral dues.
Heard learned counsel for the parties and perused the record.
Learned counsel for the petitioner would submit that the admissible dues are not paid by the respondents after retirement of the petitioner. He restricts his prayer that the respondents be directed to decide the representation of the petitioner within the given time, that may be presented by the petitioner within a period of 10 days from today.
Learned counsel for the respondents would submit that as per instructions, all the admissible dues have been paid to the petitioner. But, according to him, in case the petitioner gives another representation, it will be decided within a period of one month from the date of its receipt.
The Court takes on record the statement given by the learned counsel for the respondents.
The writ petition is disposed of with liberty to the petitioner to make a representation to respondent no.2 within a period of 10 days from today with further directions to respondent no.2 that upon such representation having been made, that shall be decided within a period of one month thereafter.
