Judgment
This miscellaneous application has been filed by the applicants for correction in the order dated 05.02.2019 passed by a Coordinate Bench of this
Court in DB Review Petition No.243/2018, whereby while passing the order, it was observed that the employees who have completed seven years of
service, shall be entitled to receive salary for the intervening period from the date of award till superannuation, and they were held entitled to receive
salary of 3½ years i.e. 50 per cent of the salary of the intervening period.
Learned counsel appearing for the applicants submits that the date of award is 16.02.2001 and the date of superannuation of 13.10.2011 and therefore,
the intervening period comes to 10 years and 8 months and therefore, the order to the extent of observation made by the Coordinate Bench as
aforesaid, deserves to be rectified.
Keeping in view the factual position on record, it is directed that in terms of the order dated 05.02.2019 passed by this Court, the employees shall be
entitled to receive 50 per cent salary of the intervening period from the date of award till the date of superannuation.
The application stands disposed of.
