Mr. Sudhir Kumar Sahoo, Inspector in-charge of Mancheswar Police Station appears through virtual mode on being instructed to the learned counsel for the State in that respect.

An order was passed on 13.04.2023 directing the Inspector in-charge of Mancheswar Police Station to appear before the learned trial Court i.e. 3rd Addl. Sessions Judge, Bhubaneswar in C.T. Case No.88 of 2020 on or before 24th April 2023 and receive summons in respect of the eye witness Mangulu Jena and ensure his attendance on the date fixed.

Learned counsel for the petitioner submitted that the Inspector in-charge of Mancheswar Police Station did not carry out the order of this Court.

Learned counsel for the State submitted that he had sent the copy of the order dated 13.04.2023 to the Inspector in-charge of Mancheswar Police Station on 18.04.2023 and documentary proof in that respect is available with him. However, the Inspector in-charge of Mancheswar Police Station submitted that he had not received any instruction from the office of the learned Advocate General.

It is a very sorry state of affairs. However, the Inspector in-charge of Mancheswar Police Station undertakes that he will ensure the attendance of the said eye witness on the date fixed which is stated to be 23rd May 2023 after receiving the summons from the learned trial Court positively.

A copy of the order be handed over to the learned counsel for the State which will be passed to the Inspector in-charge of Mancheswar Police Station and a copy of the order be also sent to the learned trial Court by the learned Registrar (Judicial).

List this matter after ensuing summer vacation. If the said eye witness is examined in the meantime, the learned counsel for the petitioner shall produce the certified copy of the deposition giving a copy thereof to the learned counsel for the State. Personal appearance of the Inspector in-charge of Mancheswar Police Station is dispensed with.
