Judgment
S.P. Khare, J.—Application by Shri M.A. Bohra, Advocate.
This is a revision by the claimants against the order by which their application for permission to pay in cash the amount of the F.D.R. has been rejected.
Argument heard.
The amount of Rs. 45,804/- was deposited on 8.11.2000. This is the amount of compensation which was awarded to the applicants on the death of their son in an accident. It is submitted on behalf of the applicants that they want to purchase Khasra No. 161 Area 3.51 acres of land in Village Tirgaon, Tehsil Kasavadh from Gulab for Rs. 50,000/-. There is already an agreement of sale in favour of the applicants. They have paid an amount of Rs. 5,000/- to the vendor. It is submitted on behalf of the applicants that the purchase of the land would be more beneficial for the applicants than the deposit in the bank. In such a situation, the applicants are permitted to withdraw the amount and the Claims Tribunal is directed to permit the applicants to encash the F.D.R. After the execution and the registration of sale deed, the applicants will submit the certified copy of the sale-deed before the Claims Tribunal.
Thus, this revision petition is disposed of.
