Arindam Sinha, J
Mr. Acharya, learned advocate appears on behalf of petitioners and presses for hearing and order. Mr. Behera, learned advocate appears on behalf of opposite parties and prays for leave to retire since his clients withdrew the brief.
Text of order dated 13th July, 2022 is reproduced below.
“1. Mr. Acharya, learned advocate appears on behalf of petitioners and submits, impugned is order dated 12th April, 2022 passed by Commissioner for Employee’s Compensation-Cum-Joint Labour Commissioner. He submits, as per award his clients had already paid. By impugned order there is direction for deposit of purported balance compensation interest amount of Rs.1,61,132/-. He demonstrates from impugned order, it bears arithmetic mistake.
Issue notice along with this order on opposite party nos.1 to 5, who all have same address. Petitioners will put in requisites.
There will be stay of operation of impugned order till next date.
The I.A. is disposed of.
List the writ petition on 3rd August, 2022.”
Leave is granted to Mr. Behera to retire.
Since opposite parties have chosen to stay away, Court is convinced petitioners’ contention is to be accepted. Impugned order dated 12th April, 2022 passed by Commissioner for Employee’s Compensation-cum-Joint Labour Commissioner is set aside and quashed.
The writ petition is disposed of.
