Judgment
10.01.2025: These two appeals have been filed against order passed by the NCLT, Ahmedabad Bench (Court-III) dated 09.08.2024 initiating CIRP against the Personal Guarantor. The Financial Creditor has filed applications which were rejected, against which these appeals have been filed.
An Affidavit has been filed by Respondent No.1 in both the appeals, whereby copy of order dated 15.10.2024 has been brought on the record passed in C.P.(IB)/229(AHM)2024, by which order CIRP against the Personal Guarantor has already been initiated on an application filed by IDBI Bank.
In view of the fact the personal insolvency against the Personal Guarantor has already initiated, no issues need to be decided in the present appeals as the appeals have become infructuous. Taking into record the order dated 15.10.2024 initiating personal insolvency against the Personal Guarantor, we close these appeals with liberty to the Appellant to revive if any such occasion arises. Both Appeals are dismissed as infructuous.
