Judgment
The matter has been taken up today as the Court did not assemble on 8th July 2021.
The matter was taken up on first call. At that time, Mr. Anil Srivastava, Advocate had appeared and submitted that he had moved an application
under Rule 6 of Armed Forces Tribunal (Procedure) Rules 2008 before Hon’ble Chairperson long back. The order is not available and in fact
counsel for the respondents also stated that he did not receive any notice of such application. As such, Registry was directed to check whether any
such application has been moved or not and the matter was ordered to be taken up at 1 PM again.
When the matter has been taken up at 1.20 PM, it has been reported by the Registry that no such application has been moved. Counsel for the
applicant however, is not responding now. Under the circumstances, in case such application is moved by the applicant then he should check from the
Registry and get the application placed on record so that same be put up before Hon’ble Chairperson on administrative side otherwise he will be at
liberty to move the appropriate application within 10 days.
Re-list on 7th September 2021.
