There is a delay of 137 days in filing the present appeal due to the reasons as mentioned in the application. After considering all facts, the delay of 137 days in filing the present appeal is condoned. The application is accordingly allowed.
Appeal No.299/2023
The appellant filed O.A. bearing no.113/2018 titled as Canara Bank V. Narayan Construction & Tiles & another which was ordered to be dismissed vide the impugned order dated 21.02.2023 by DRT, Jaipur. DRT in the impugned order observed that there was no debt which could be proved against the respondents, as the appellant failed to file necessary documents.
The counsel for the appellant stated that the necessary documents were seized by the CBI and as such could not be placed on record during the trial of O.A. bearing no.113/2018.
The perusal of the impugned judgment dated 21.02.2023 reflects that the appellant could not prove debt in accordance with law as necessary documents were not placed on record of the O.A. There is no illegality or infirmity in the impugned order dated 21.02.2023 which warrants interference by this Tribunal. The appeal is dismissed accordingly.
