Ld. Counsel Mr. Akhil Suresh appears on behalf of the Liquidator. Ld. Liquidator CA, Mr. Jasin Jose also present. Respondent is represented by Ld. Counsel Mr. Wazim. K.

In respect of Prayer-a in the application at Page No. 14, the petitioner has produced the inventory list. It is apparent from the same that the original title document in respect of 22 cents of project land has not been received by the Liquidator. However, Ld. Counsel appearing for the respondent claims that the same is not in their possession. Respondent is directed to arrange for the original document and hand over the same to the Liquidator within 15 days' time. In case respondent is unable to produce the documents, they should file an affidavit giving sufficient reasons that why they are unable to provide the same.

In respect of Prayer-b regarding fencing of 88 cents project land, Ld. Liquidator is directed to get the same done in accordance with the revenue records. If he faces any difficulty in demarking the boundaries of the land, he can do the same with assistance of revenue officials concern as per law. Respondents are directed to extend all cooperation to Liquidator in this regard. In respect of prayer C, respondents are directed to provide the required information as has been sought by the Liquidator, in respect of debtors vide email dated 15.12.2021 within 15 days' time.

List the matter for reporting compliance by the respondent in respect of Prayers a and c on 20.10.2022. Respondent to note that in case of any non-adherence to the aforesaid order, the law shall take its own course.

Ld. Counsel Mr. Akhil Suresh appears on behalf of the Liquidator. Ld. Liquidator CA, Mr. Jasin Jose also present. Respondent is represented by Ld. Counsel Mr. Wazim. K. After hearing the Ld. Counsel and Ld. Liquidator, this Tribunal orders the respondent to hand over the files/ documents of the arbitration appeal pending in the High Court in the matter of MS Shilpa Constructions Ltd. to the Liquidator within a week's time. With the above order, Application is ALLOWED and the matter is Disposed Of accordingly.
