The petitioner seeks a direction to the Trial Court to dispose of the application dated 20.09.2016 filed by the petitioner before the Trial Court.
The petitioner in the subject proceedings, being the original complainant, has filed an application seeking cancellation of bail of Respondent No. 2 in R.C.No.2(A)/2006/ACU IX/CBI /PS/CBI/SC-I/ND. Learned counsel for the petitioner submits that the present petition is restricted only to the expeditious disposal of the cancellation of the bail application.
Learned counsel for the petitioner submits that the pleadings are complete in the subject application and the next date fixed before the Trial Court is 23.04.2018.
Learned counsel appearing for the Central Bureau of Investigation has no objection to the expeditious disposal of the subject application.
Accordingly, the Trial Court is directed to dispose of the petitioner's application on the next date and in case for any reason it is not possible to dispose of the same on the next date then to dispose of the same preferably within a period of six weeks from the said date in accordance with law.
It is clarified that this Court has neither examined nor commented upon the merits of the application or the defence of the respondent. The Trial Court is directed to dispose of the application without being influenced by anything stated in this order.
The Petition is accordingly disposed of.
