Judgment

The petitioners - residents of K.Badaga village are members of respondent No.6-Society. The said Society is an agricultural co-operative Society, formed for the benefit of farmers of Kutta and other surrounding villages in the Taluka of Virajpet. Presently, a new co-operative society has been formed for the benefit of farmers of K.Badaga village and all the farmers of the said village including the petitioners are required to become members of the new society. Aggrieved by the same, the present writ petition is filed.
The case of the petitioners is that they have borrowed loans from respondent No.6-Society and making them to become members of the new society will adversely effect their rights.
The learned Additional Government Advocate has filed a memo dated 19.09.2023 and, upon instructions, he submits that the petitioners herein have borrowed loans from respondent No.6-Society and hence, they along with similarly situated persons are not made to become members of the new society and instead are permitted to continue in the respondent No.6-Society till their liabilities are discharged. It is also submitted that they are also permitted to participate in the elections either by way of contesting or voting in the elections to be held to respondent No.6-Society in the manner known to law.
The writ petition is disposed of by recording the submission of learned Additional Government Advocate.
