Judgment
At the request of Mr. Vernekar, learned Additional Government Advocate the matter is kept at 2.30 p.m.
In the meanwhile, the officials from the respondent Nos.2 and 3 should forthwith visit the site in question i.e. Survey No.33/1 of Village Borkotem, Mollem Goa, and ensure that quarrying works at the site, if they are not backed by any permissions should stop immediately.
We make the above order because Mr. Kulkarni, learned counsel for the petitioner points out that after the petition was served upon the respondents, a raid was conducted at the site on 25.07.2022 and even an FIR has been filed. He however states that only some minor machinery items have been seized. He also states that JCB and other machinery have not been seized as a result of which the illegal quarrying continues at the site.
If the above allegations are correct then indeed this is a serious matter and therefore, we direct the officials to go to the site and inform us about the status of the activities at the site by 2.30 p.m.
Mr. Vernekar agrees to communicate the contents of the order to the officials forthwith.
