Judgment

Application for recalling having been allowed, the order dated 05.01.2024 is recalled and Civil Contempt Petition is restored to the Board. With consent of the parties, matter is taken up for hearing.
This complaint alleges violation of order entered in W.A.No.551/2022 wherein a direction was given to reinstatement and for the payment of 50% back wages.
Learned AGA appearing for the respondents has filed a Memo to the effect that the Complainant has been paid back wages in a sum of Rs.9,01,457/- (Rupees Nine Lakh One Thousand Four Hundred & Fifty Seven) only. He hastens to add that since already the Complainant is being reinstated in service, there is substantial compliance of the writ and therefore, these proceedings be dropped.
In the above circumstances, this application is disposed off reserving liberty to the Complainant to take appropriate proceedings if some more amount is due in terms of order whose violation is complained of, in accordance with law. In that connection all the contention of both the sides are kept open.
