M.M. Kumar, J.—This is an application seeking withdrawal of the writ petition being CWP No. 14726 /CAT of 2009. According to the prayer made in the application the Applicant- Petitioner has filed a representation before the Respondent authorities requesting for dropping memo dated 1.3.2006. On 1.3.2011 (''A'') he has been intimated that memo dated 1.3.2006 against the Applicant- Petitioner may be withdrawn subject to the condition that would withdraw the instant petition which is pending before this Court.

Mr. Gurpreet Singh, learned Counsel for Respondent No. 1 and Mr. Piyush Kant Jain, Addl. Advocate General, Punjab who are present in the Court accepts notice.

After hearing learned Counsel for the parties and in view of letter dated 1.3.2011 (''A''), we are of the view that the application deserves to be allowed because Respondent No. 1 has shown inclination to withdraw memo dated 1.3.2006 pending against the Applicant- Petitioner subject to withdrawal of the petition. Accordingly, the application is allowed. The writ petition is dismissed as withdrawn.
