Judgment

Heard learned counsel for the parties.
Instant petition has been preferred beseeching expeditious disposal of enquiry on the basis of complaint dated 25.08.2022 moved by the present petitioner under Rule 3 of the U.P. Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997 (in brevity 'Rules, 1997').
It is submitted that application dated 25.08.2022 moved by the present petitioner has not been decided till date despite the fact that statutory provision of six months to decide the same as enunciated under Rule 8 of Rules, 1997 has already been expired.
Learned Standing Counsel has no objection, if a direction is issued to the authority concerned to decided the aforesaid application, expeditiously.
In this conspectus as above, no useful purpose would be served to keep this matter pending. Therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case, as mentioned in the writ petition, with a direction to the District Magistrate, Ghazipur (Respondent no. 2) to decide the aforesaid case, strictly in accordance with law by means of a reasoned and speaking order, after affording opportunity of hearing to the parties concerned and without granting any unnecessary adjournments to either of the parties expeditiously, preferably, within a period of five months from the date of production of certified copy of this order.
With the aforesaid direction, this petition is finally disposed of.
