This matter is taken up today in the 1st National Lok Adalat through Hybrid Mode for settlement on the basis of compromise.

Heard learned counsel for the Appellant and learned counsel for the Respondent No.1.

This appeal has been filed by the Appellant- Insurance Company.

As agreed to, the amount of compensation is settled at Rs.16,70,325/- (Rupees Sixteen Lakh Seventy Thousand Three Hundred Twenty Five) consolidated. The compromise sheet signed by both the parties/their authorized representatives is taken on record.

Mr. Khan, learned Counsel for the Appellant- Insurance Company submits that in terms of the impugned Judgment, the Appellant-Insurance Company has already deposited Rs.18,83,943/- before the Commissioner for Employee's Compensation-Cum-Joint Labour Commissioner, Rourkela and seeks for a direction to refund the differential amount with accrued interest, after deducting the amount of Rs. 16,70,325/- with accrued interest there on from the said deposited amount.

In view of the submissions made and as agreed between the parties, the Commissioner for Employee's Compensation-Cum-Joint Labour Commissioner, Rourkela is directed to disburse the modified amount of Rs. 16,70,325/- with accrued interest thereon, in favour of the Claimant in accordance with law and refund the balance amount with accrued interest thereon in favour of the Appellant-Insurance Company within a period of 15 days from the date of production of the copy of this order.

As the case is disposed of in the spirit of the Lok Adalat, no court fee is liable to be paid by the claimant.

The FAO is accordingly disposed of.

Urgent certified copy of this order be granted as per rules.
