Heard Mr. Mohapatra, learned counsel for the petitioners, Mr. S.K. Samal, learned Addl. Govt. Advocate and Mr. Sitakanta Hota, learned counsel on
behalf of Mr. S.K. Dwibedi, learned counsel for opposite party no.2- Jakir Hussain through video conferencing mode.
Since the State Consumer Disputes Redressal Commission, Odisha, Cuttack has already become functional and the First Appeal filed by the petitioner
i.e. F.A. No.28 of 2020 has been fixed to 25.08.2021, Mr. Mohapatra wants to withdraw this case as he wants to pursue the First Appeal with a
prayer that during interregnum, the petitioners may be protected in tune with the existing interim order.
Considering such submissions, the petitioners are permitted to withdraw the writ petition to pursue the above noted First Appeal pending before the
State Consumer Disputes Redressal Commission, Odisha, Cuttack fixed to 25.08.2021. Till that date, execution proceeding in E.A. No.01 of 2020
pending before the District Consumer Disputes Redressal Forum, Jagatsinghpur shall remain stayed.
Accordingly, the writ petition is disposed of as withdrawn. Parties may utilize the soft copy of this order available in the High Court’s Website or
print out thereof at par with certified copy in the manner prescribed vide Court’s Notice No.4587 dated 25.3.2020 read with Notice No.4798 dated
15.04.2021.
