This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

The present writ petition has been filed seeking for a direction to the opposite party No.2- Sub-Registrar, Pallahara, District- Angul to accept the documents for registration purpose. The matter is covered by the decision of this Court in the case of Sitarani Rath vs. The Inspector General of Registration, Odisha and Ors., 2015 (II) ILR- CUT-344.

Regard being had to the facts and submissions and the nature of relief sought for, the matter being squarely covered by the decision of this Court in the case of Sitarani Rath (supra), said decision shall govern this case also.

Accordingly, the petitioner is directed to tender the instrument for registration before the Sub-Registrar, Pallahara, District- Angul-Opposite Party No.2, within three weeks from today. If such instrument is tendered before the Opposite Party No.2, the same shall be accepted in accordance with the decision of this Court in the case of Sitarani Rath (supra). The question of registerability or non-registerability of the instrument shall however be decided by the Sub-Registrar, by passing a reasoned order, within a period of two months from the date of presentation of the instrument.

The writ petition is accordingly disposed of.

Urgent certified copy of this Order be granted as per rules.
