As common issues are involved in the captioned petitions, with the consent of both sides, the same are hereby disposed of by this common order. For the sake of brevity and convenience, facts are borrowed from CWP-3949-2007.
The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 19.10.2006 whereby DGP recalled order dated 07.11.2003 passed by his predecessor with respect to adverse remarks recorded in the ACR. He is further seeking setting aside of show cause notice dated 16.02.2007 whereby he was called upon to show cause as to why he should not be reverted to the rank of Head Constable.
A Division Bench of this Court while issuing notice of motion ordered to maintain status quo. The petitioners have retired on attaining the age of superannuation. On account of interim orders of this Court, they continued to hold their rank.
Keeping in view the fact that petitioners have already retired and they continued to hold higher rank in view of interim orders of this Court, I find it appropriate to make interim orders absolute.
Disposed of.
