The petitioner has approached this Court, seeking for a writ in the nature of mandamus, directing second respondent to consider the representations dated 18.02.2025, produced as per Annexures B-1 and B-2 and to direct the third respondent to consider the representation dated 02.04.2025 produced as per Annexure C.
Heard Sri. Abhinay Y.T., learned counsel for the petitioner and learned Additional Government Advocate for respondents. Perused the material on record.
According to the learned counsel for the petitioner, the petitioner is one of the three bidders who submitted their bids for transportation of food grains from Godowns and arranging in-stack as per direction of Godown in-charge. It is the case of the petitioner that the bid submitted by the other two bidders are defective in nature and are therefore liable to be rejected. In that regard, he has submitted representations as referred to above.
The respondents cannot have any objection for consideration of the representations dated 18.02.2025 and 02.04.2025 submitted to respondents No.2 and 3, respectively.
Hence, I proceed to pass the following:
ORDER
(i) The writ petition is allowed.
(ii) The respondents No.2 and 3 are directed to consider the representations dated 18.02.2025 and 02.04.2025 submitted to respondents No.2 and 3, respectively, as referred above, in accordance with law, within a period of four weeks from today.
