Judgment
The Court : From the General Manager''s approved panel of retired Railway
Officers for the post of the Arbitrator as handed up to this Court by their learned
Counsel, I appoint Mr. Arjun Rakhit, Ex Additional Member (Finance), Railway
Board as the Arbitrator. He shall be treated as the petitioner''s nominee. As the
claim is nearly Rs.60 Lacs, an Arbitral Tribunal has to be constituted. The
Railway shall appoint their Arbitrator in accordance with the G.C.C. The
Presiding or third Arbitrator may be also appointed according to the Rules. The
Arbitral Tribunal shall adjudicate upon the disputes between the parties raised
in the petition and those to arise on exchange of the Statement of Claim, Counter
Statement and Counter Claim, if any, between the parties.
The remuneration of the Arbitrators and their staff will be according to the
Railway norms.
The Arbitral Tribunal is requested to make and publish their Award by 30th
June, 2018.
This application is, accordingly, disposed of.
Certified photocopy of this order, if applied for, be supplied to the parties
upon compliance with all formalities.
