Judgment
These Appeals have been filed against the order passed by the Adjudicating Authority dated 26.07.2023 passed in several I.As. Company Appeal (AT) (Ins.) No. 1273 of 2023 has been filed against order on I.A. No. 3277 of 2023 and Company Appeal (AT) (Ins.) No. 1274 of 2023 has been filed against order on I.A. No. 3280 of 2023.
Learned counsel for the Respondent has pointed out that against the same order dated 26.07.2023, Company Appeal (AT) (Ins.) No. 1088 of 2023 was filed by ‘Engine Lease Finance B.V.’, which Appeal has been disposed of by this Tribunal on 18.08.2023.
We are of the view that present Appeals are also covered by the said order and need to be disposed of in terms of order dated 18.08.2023.
Learned counsel for the Appellant expressed his apprehension that his other contentions in the applications have to be treated to be left open.
We in our order dated 18.08.2023 in Para 13 have observed as follows:
“13. We are of the view that inspection be permitted within 10 days from today. As observed above, the observations made in the impugned order being at prima facie stage need not be treated as final expression of opinion by the Adjudicating Authority and all contentions of both the parties are left open.”
In view of the aforesaid, the apprehension of the Appellant is without any basis. Appeals are disposed of in terms of the order dated 18.08.2023.
