Pursuant to our earlier order dated 11th  March, 2021, an enquiry was  made  by  the  Superintendent  of  Police,  East  Khasi  Hills,  District, Shillong. An affidavit, affirmed on 23rd  March, 2021, in this regard, has been filed on behalf of the concerned Superintendent of Police. Paragraph 3 of the affidavit, which is relevant in the context of the instant matter, is reproduced hereinbelow:-

"3. That in compliance with the order dated 11.03.2021 passed by the Hon'ble High Court in WP (Crl) No.1 of 2019, an inquiry has been made to ascertain the place where the Respondent No.6 is residing. Accordingly, S.I. Rajat Ghosh of Crime Branch Police Station, Shillong alongwith one Constable were deputed to West Tripura, Agartala for causing on the spot verification as to whether the private Respondent No.6 (Smti. Sangita Ghosh) is actually residing at the above mentioned place alongwith her children or not.

Accordingly the deputed officer alongwith Tripura Police visited the place and met Smti. Sangita Ghosh and found that Respondent No.6 residing in the rented house of Shri Goutam Saha at Moloynagar near Moloynagar Panchayat Office, Opposite Government Fair Price Shop, Moloynagar under Srinagar Police Station, Dist: Tripura, alongwith her daughter Miss Sonakshi Ghosh (8 yrs) and son Master Bihan Ghosh (3 yrs)".

Considering the fact that the whereabouts of the two children of the writ petitioner and the private respondent No.6 has now been ascertained and established, we do not find any useful purpose in keeping the instant habeas corpus writ petition pending. It will be open to the writ petitioner to take further steps in the matter before the appropriate forum in accordance with law.

Writ petition stands disposed of accordingly.
