Petitioner retired as a Conductor from Himachal Road Transport Corporation on 30.6.2010, but he was not released the pensionary benefits alongwith leave encashment, as such filed the present petition.
The respondents, in their reply, submitted that the GPF amount to the tune of Rs. 42,693/-was released to the petitioner on 26.11.2010 and the leave encashment of Rs. 1,52,270/- on 5.8.2010. The commutation of value of pension amounting to Rs. 2,40,080/- on 18.6.2011. They have further stated that whatever delay was there, was attributable to the fact that the pension case of the petitioner could not be finalized due to the revision of the pay-scale as the service record of the petitioner was not readable being very old.
Since the petitioner retired on 30.6.2010 and he was released the leave encashment on 5.8.2010, therefore, the petitioner is only entitled to the interest @ 12% p.a. on this amount w.e.f. 1.9.2010 till its actual release, which shall be paid by the respondents to the petitioner within two months from the receipt of the copy of this judgment.
With this direction, the petition stands disposed of, so also the pending application(s), if any.
