Judgment

This application under Section 439 of Cr.P.C. has been filed in connection with M. Rampur P.S. Case No. 145 of 2023 corresponding to C.T. Case No. 285 of 2023 pending in the Court of the learned J.M.F.C., Rampur, registered under Sections 420, 489-A, 489-B, 489-C of IPC.
The allegations in brief against the petitioner are that on 26.06.2023, the Assistant Sub-Inspector of Risida Out-Post under M.Rampur Police Station on receiving information about possession of fake notes by a person standing near Risida Hospital, arrived at the spot accompanied by a constable and found the petitioner going towards Sishu Mandir. After he disclosing his identity, the informant searched his pocket and found 100 nos. of Rs.2,000/- denomination fake currency notes. The currency notes were sent to the Branch Manager, State Bank of India for examination and opinion regarding genuineness and the Branch Manager informed that the same are to be impounded as they are fake notes.
Mr. H.S. Mishra, learned counsel for the petitioner submits that the petitioner is in custody since 26.06.2023 and the allegations in the F.I.R. do not make out any of the offences alleged in the F.I.R. against him.
Mr. S.S. Pradhan, learned Additional Government Advocate submits that the allegations make out the offences under Section 489-B and Section 489-C of the IPC against the petitioner and his involvement under Section 489-A of IPC is under investigation.
Considering the nature of allegations against the petitioner and as the investigation is still in progress, I am not inclined to release the petitioner on bail at this stage.
The BLAPL is accordingly dismissed granting liberty to the petitioner to move the learned court below afresh for bail after completion of investigation.
Urgent certified copy of this order be granted on proper application.
