Judgment
This matter is taken up through Hybrid Mode.
Heard learned counsel for the parties.
The petitioner had filed W.P.(C) No.29190 of 2013 seeking to restrain Seven Star Steel Private Limited from plying its heavy vehicles on the road leading to the village as the same was deteriorating the road condition on daily basis. Further, direction was sought for the official opposite parties for undertaking the repair work of the said village road stretching from Patrapali to Gudigan. The said Writ Petition was disposed of vide order dated 11th September, 2014 by the Court directing the Collector, Jharsuguda to dispose of the representation of the petitioner in the aforesaid regard.
Since the needful was not done, the present contempt has been filed.
After hearing learned counsel for the petitioner and State, we find no reason to pursue the present contempt.
The directions are general in nature and essentially a matter of Policy to be taken by the Government. That apart, a right of the Company guaranteed under Article 19(1)(g) of the Constitution of India cannot be interfered with at the mere asking of a disgruntled person.
In view of the above, there is no ground to invoke the Contempt jurisdiction.
Accordingly, the CONTC is dismissed.
