Heard both the sides.
The petitioner- Binod Yadav @ Vinod Yadav is in custody since 21.12.2022 in connection with Sadar P.S. Case No. 287 of 2020 for the offence registered under Sections 15 and 18 of NDPS Act pending in the Court of learned Principal Sessions Judge cum Special Judge, NDPS, Chatra.
It is submitted by the learned counsel on behalf of petitioner that nothing has been seized from him and he has been implicated in this case only because his motorcycle was seized with the main accused along with narcotics. The main accused from whom narcotics have been seized was put on trial and has been acquitted of the charges in NDPS Case No.08 of 2021.
Learned A.P.P. opposed the prayer for bail. It is submitted that narcotics were seized from his motorcycle.
Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
