Judgment
Petitioners, who are stated to be major, claim that after falling in love, they have married against the wishes of their parents on 27.12.2017 at
Panchkula. Since, it is an inter caste marriage, private respondent nos.4 and 5 are opposing the same. They apprehend threat to their life and
liberty. The photographs of the marriage have been placed on file as Annexure P-4. True and correct translated copy of marriage certificate has
been placed on file as Annexure P3. True relevant extract copies of Aadhar Card of petitioner no.1 and petitioner no.2, showing their date of birth
have been placed on file as Annexures-P-1 to P-2 respectively.
On the request of respondent no.4, he was allowed to talk to petitioner no.1 in the Court room for about 15 minutes. Thereafter, both the
parties were questioned. Petitioner no.1 reiterated that she has married petitioner no.2 of her own free will and her decision is final.
It is claimed that the petitioners have moved an application dated 27.12.2017 (Annexure-P-5) before the police authorities for protecting their
life and liberty as they apprehend danger to their life from the private respondents.
In these circumstances, the present petition is disposed of with a direction to the Commissioner of Police, Ludhiana, to consider the application
of the petitioners dated 27.12.2017 (Annexure-P-5) and assess the threat perception to the life and liberty of the petitioners and if it is found that
there is danger to the life of the petitioners, necessary steps be taken to protect the life and liberty of the petitioners.
However, it is made clear that this order shall not be taken to be the proof of valid marriage. Disposed of accordingly.
