The petitioner has filed the present petition for quashing of FIR No. 86 of 2024, dated 20.9.2024, registered at Police Station Kandaghat, District Solan, H.P., for the commission of offences punishable under Sections 332(c), 324(4), and 118(1) of the Bharatiya Nyaya Sanhita, 2023 (BNS), based on a compromise arrived at between the parties.
It has been asserted that the petitioner and the informant have compromised the matter with the intervention of respectable persons of the society. The informant does not want to proceed further with the matter after the compromise. Hence, the petition.
The statement of the informant/victim, Ajay Singh, was recorded on 14.7.2026, in which he stated that he had entered into a compromise with the petitioner voluntarily, without any influence from any person, and that he had no objection to the quashing of the FIR based on the compromise arrived at between the parties.
I have heard learned counsel for the parties and have gone through the record carefully.
Sections 118(1), 324(4), and 332(c) of BNS correspond to Sections 324, 427, and 451 of the Indian Penal Code, 1860, respectively. Section 359 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) makes the offences punishable under Section 324(4) and Section 332(c) compoundable. This Court had already quashed the F.I.R. registered for the commission of an offence punishable under Section 324 of IPC in Ram Krishan alias Ramu vs. State of H.P.& others Latest HLJ 2021(2)(HP) 1327, Amir Hussain vs State of Himachal Pradesh 2022(1)Him.L.R.195, Braham Dass & others vs. State of H.P & others 2022(1) Him.L.R.466, Inderjeet Singh & others vs State of H.P. & others 2022(2)Him.LR.1217, Raj Kumar @ Raj & Ors. vs. State of Himachal Pradesh & Anr. Latest HLJ 2022(HP) (1) 759 and Rukam Deen Vs State of Himachal Pradesh 2023(1) Him. L.R.(HC) 616 based on the compromise. These judgments are binding on this Court.
Consequently, the present petition is allowed and FIR No. 86 of 2024, dated 20.9.2024, registered at Police Station Kandaghat, District Solan, H.P., for the commission of offences punishable under Sections 332(c), 324(4), and 118(1) of BNS and consequential proceedings pending/initiated against the petitioner-accused in pursuance thereto are quashed.
Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any.
